Terms of Service
These Terms of Service ("Terms") govern your access to and use of MyOrbisAgents, including the Orby AI assistant, dashboards, phone and messaging services, and website (the "Service"), provided by MyOrbisResults ("we," "us"). By creating an account or using the Service, you agree to these Terms.
1. Who may use the Service
You must be a licensed real-estate professional (or authorized staff of one) and at least 18 years old. You are responsible for the accuracy of the information you provide and for all activity under your account.
2. The Orby AI assistant
Orby is an artificial-intelligence assistant. Orby is not a licensed real-estate agent, attorney, or lender, and does not provide legal, financial, or professional advice. You remain the licensed, responsible party for every transaction. You are responsible for reviewing the listings, prompts, and business information you provide to Orby and for supervising its interactions with your clients.
3. Your content and listings
You retain ownership of the listings, contacts, and business information you provide. You grant us a limited license to process that content solely to operate the Service for you. You represent that you have the right to provide it and that it is accurate and lawful.
4. Acceptable use
You agree not to use the Service to violate any law, including fair-housing, telemarketing, consumer-protection, and privacy laws; to send unsolicited or unlawful communications; to misrepresent properties; or to interfere with the Service. You are responsible for obtaining any consent required to call, text, or record the individuals you contact through the Service.
5. Fees and billing
Paid plans are billed in advance on a monthly or annual basis through our payment processor. Setup fees are one-time and non-refundable once setup work has begun. Except where required by law, fees are non-refundable. We may change pricing on renewal with notice.
6. Third-party services
The Service integrates with third parties such as Google (Calendar, Gmail), Twilio, Stripe, and others. Your use of those services is subject to their own terms. We are not responsible for third-party services.
7. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features. We will give reasonable notice of material changes where practical.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses may be inaccurate or incomplete; you are responsible for reviewing them before relying on them.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of the Service will not exceed the amount you paid us in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law, including fair-housing and communications laws.
11. Termination
You may cancel at any time. We may suspend or terminate your access for violation of these Terms or applicable law. Upon termination, your right to use the Service ends; certain provisions survive.
12. Governing law
These Terms are governed by the laws of the United States and the state in which MyOrbisResults is organized, without regard to conflict-of-laws rules.
13. Changes to these Terms
We may update these Terms. We will post the updated version here and update the "Last updated" date. Continued use after changes take effect constitutes acceptance.
